Terms of Service

This End-User License Agreement ("EULA") is between you and Ayaan Majeed ("Developer") only, and not with Apple Inc. ("Apple"). The Developer, not Apple, is solely responsible for the First Steps application ("the App") and its content.

By downloading, installing, or using the App, you agree to be bound by these Terms of Service. If you do not agree with these terms, please do not use the App.

The Developer grants you a limited, non-exclusive, non-transferable, revocable license to use the App on any Apple-branded device that you own or control, as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions.

You may not distribute, sublicense, or make the App available over a network where it could be used by multiple devices at the same time.

First Steps is a parenting guide app that helps parents and guardians:

• Track child developmental milestones
• Save memories through photos and diary entries
• Chat with an AI Coach for parenting guidance

The App is designed for use by parents and guardians. It is not intended for use by children.

You may create an account using Sign in with Apple. You are responsible for maintaining the security of your account and for all activities that occur under it.

You agree to provide accurate information and to update it as necessary. You must be at least 18 years old to create an account.

First Steps offers premium features through paid subscriptions managed by Apple via the App Store.

• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period
• Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period
• You can manage and cancel subscriptions in your Apple ID account settings
• Any unused portion of a free trial period is forfeited when you purchase a subscription

Prices are subject to change. We will notify you of any price changes in advance. All payments are processed by Apple and are subject to Apple's terms and conditions.

The Developer is solely responsible for providing maintenance and support services for the App, as specified in this EULA or as required under applicable law.

Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App.

The AI Coach feature provides general parenting guidance and informational content only. It is powered by OpenAI and is not a substitute for professional medical, psychological, or developmental advice.

• AI Coach responses are generated by artificial intelligence and may not always be accurate or complete
• Do not rely on AI Coach for medical diagnoses, emergency situations, or critical health decisions
• Always consult qualified healthcare professionals for concerns about your child's health or development

We make no warranties regarding the accuracy, reliability, or completeness of AI Coach responses.

You retain ownership of all content you create in the App, including photos, diary entries, milestone notes, and child profile information ("User Content").

By using the App, you grant us a limited license to store, process, and display your User Content solely for the purpose of providing and improving the service.

You are responsible for ensuring you have the right to upload any content, including photos. Do not upload content that is illegal, harmful, or violates the rights of others.

You agree not to:

• Use the App for any unlawful purpose
• Attempt to gain unauthorized access to the App or its systems
• Interfere with or disrupt the App's functionality
• Upload malicious content, viruses, or harmful code
• Use the AI Coach to generate harmful, abusive, or inappropriate content
• Misrepresent your identity or impersonate another person

We reserve the right to suspend or terminate accounts that violate these terms.

The App is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee that the App will be uninterrupted, error-free, or free of harmful components.

The Developer is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App.

The Developer, not Apple, is responsible for addressing any claims by you or any third party relating to the App or your possession and/or use of the App, including but not limited to:

• Product liability claims
• Any claim that the App fails to conform to any applicable legal or regulatory requirement
• Claims arising under consumer protection, privacy, or similar legislation

The App, including its design, features, code, and branding, is owned by the Developer and protected by intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the App.

The First Steps name, logo, and related marks are trademarks of the Developer. You may not use them without prior written consent.

In the event of any third-party claim that the App or your possession and use of the App infringes that third party's intellectual property rights, the Developer, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.

You represent and warrant that:

• You are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country
• You are not listed on any U.S. Government list of prohibited or restricted parties

You agree to comply with all applicable local, state, national, and international laws and regulations in connection with your use of the App.

You may delete your account at any time through the App:

Settings → Account → Delete Account

Before deleting your account, please cancel any active subscriptions through your Apple ID settings to avoid continued billing. Deleting your account will remove your data within 30 days.

We may suspend or terminate your account if you violate these terms, with or without notice.

To the maximum extent permitted by law, the Developer shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the App.

This includes, without limitation, damages for loss of data, loss of profits, or any damages resulting from reliance on AI Coach responses or milestone tracking information.

Our total liability to you for any claim arising from these terms or your use of the App shall not exceed the amount you paid for the App in the 12 months preceding the claim.

You must comply with applicable third-party terms of agreement when using the App. This includes, but is not limited to, your wireless data service agreement when using the App over a mobile network.

The App uses OpenAI to power the AI Coach feature. Your use of AI Coach is also subject to OpenAI's usage policies.

You acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of this EULA. Upon your acceptance of these terms, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary thereof.

We may update these Terms of Service from time to time. We will notify you of material changes by updating the "Last updated" date at the top of this page. Your continued use of the App after changes constitutes acceptance of the updated terms.

If you do not agree with the updated terms, you should stop using the App and delete your account.

These terms shall be governed by and construed in accordance with applicable law. Any disputes arising from these terms or your use of the App shall be resolved through good-faith negotiation first, and if necessary, through binding arbitration or applicable courts.
